3 Men Posing as Police Raped Minor Girl: Arrested Within 12 Hours

Three men allegedly posing as policemen gang-raped a 17-year-old girl at Aastha Kunj Park near Kalkaji Temple, with all three accused arrested within about 12 hours.

All three accused- Asif, Hemant and Mukesh- were arrested within about 12 hours. Asif was shot in the leg after police said he opened fire during his arrest.

The incident happened on the girl’s 17th birthday. She had travelled from Faridabad to Delhi with her 17-year-old male friend. The two first visited Kalkaji Temple to offer prayers.

At around 7:30 pm, they entered Aastha Kunj Park through Gate No. 7 and went towards a quieter part of the park. Three men, believed to be between 25 and 30 years old, approached them.

According to police, the men pretended to be policemen and questioned the teenagers. They used police- and lawyer-like language and told them that they were minors, were doing something wrong and that a case could be registered against them.

The men then separated the girl from her friend and took her towards a secluded area. Police said they took her to an old, damaged stone structure inside the park.

According to the police complaint, Asif threatened the girl with a pistol and a knife. The three men allegedly raped her one after another. They also held and beat her male friend before threatening both teenagers and leaving the park.

At around 8:45 pm, the boy called the police. Police reached the park and recorded statements from both teenagers.

The girl and her friend gave police information about the three men, including their clothes and the names or nicknames they used. This information helped investigators identify the accused.

The girl was taken to AIIMS for a medical examination. Crime and forensic teams also examined the park and collected evidence.

An FIR was registered at Amar Colony police station under relevant sections of the Bharatiya Nyaya Sanhita (BNS) and the Protection of Children from Sexual Offences (POCSO) Act. Reports citing the FIR list Sections 70(2), 61(2), 115(2) and 351(3) of the BNS, along with Sections 6 and 17 of the POCSO Act.

Several police teams were formed to identify and arrest the accused. Investigators examined CCTV footage from the park and nearby areas, along with other technical information.

On the morning of 22 September, police received information that Asif would be in the Amar Colony area. Police tried to arrest him near DM Office Road.

According to police, Asif fired three rounds at the police team. One bullet hit Head Constable Rajesh’s bulletproof jacket. Rajesh then fired two rounds in self-defence, and one bullet hit Asif in his right leg.

Police arrested Asif and took him to the AIIMS Trauma Centre for treatment. A pistol was also recovered from him. Asif lived in Amar Colony and worked as an onion wholesaler at Okhla Mandi.

Police then continued searching for the other two accused, brothers Hemant and Mukesh. Hemant is a lawyer, while Mukesh is a final-year BSc Mathematics student. The brothers are from Faridabad and live in Delhi’s Sri Niwaspuri.

Police arrested Hemant and Mukesh from their home. The three men knew each other and were familiar with the area around the park. Police are also checking whether the three men were involved in any other incidents at the park. So far, no other complaint has been received against them.

Their father, advocate J R Dhankar, gave a different account. He said police took his two sons from their home at around 7 am on 22 September without explaining why they were being detained. He alleged that his sons were beaten and said they had no connection with the girl. He also claimed that his sons were being framed.

Police said Aastha Kunj Park, managed by the Delhi Development Authority (DDA), can be entered from several sides. Parts of the boundary wall have collapsed, some gates do not have guards and some areas do not have enough lighting. Police also conducted patrolling and a safety awareness drive at the park after the incident.

Lady Shri Ram College, located near the park, cancelled classes after the incident and temporarily moved classes online. The college also asked students and staff to avoid gathering near its back gate and requested increased police patrolling around the campus.

The Delhi Commission for Women has taken suo motu cognisance of the incident and asked Delhi Police for a detailed report.

The case is the fourth reported incident involving the alleged sexual assault of a minor in Delhi in about two weeks. Police investigations are continuing.
